Help with traffic tickets and arrest in western New York

The majority of traffic violations are minor, non-criminal infractions that can be reduced through traffic school. Other offenses—especially driving while intoxicated or driving under the influence—can result in costly, serious consequences.  You may even be threatened with imprisonment for some of the gravest violations, particularly if they result in injuries or death.  Traffic laws cover actions before driving, while driving and afterward, including—
  • Driving the wrong way
  • Driving with a revoked or suspended license
  • Driving while ability impaired (DWAI)
  • Driving under the influence (DUI)
  • Driving while intoxicated (DWI)
  • Endangering the welfare of a minor
  • Failure to stop
  • Getting required insurance
  • Hand-held cell phone usage
  • Improper turning
  • Obtaining a valid driver’s license
  • Open container violations
  • Possession of drugs or alcohol
  • Reckless driving
  • Speeding
  • Vehicle searches
  • Waiting for law enforcement after an accident
  • Yielding right-of-way

Avoiding license suspension

Even minor traffic violation citations can cause major problems, and these multiply if you are found guilty of several violations over a short period of time. Your license may be suspended, your auto insurance premiums likely increase and you may have to pay fines.

We have successfully represented hundreds of clients charged with traffic violations, misdemeanors and felonies in all local courts including the cities, towns, villages and counties of western New York.  In particular, we are sensitive to the importance of maintaining your driving privileges and commonly represent our clients at Department of Motor Vehicles hearings in this regard.  Contact our seasoned traffic violations and DUI firm for assistance as soon as possible after you have received a traffic ticket or been charged with a serious offense.

Driving while impaired (DWAI) or driving while intoxicated (DWI)

DWAI stands for driving while ability impaired and DWI, or, driving while intoxicated are always serious offenses—especially when you injure or kill someone with your vehicle.  Whenever you are faced with a DWI charge, you are in very serious trouble and need representation by a qualified DWI lawyer.  The penalties you face are significant, including—
  • Attendance at a victim impact panel
  • Dramatic increases in your automobile insurance premiums
  • Installation of an ignition interlock device
  • Jail time
  • Large fines
  • Mandatory NYS surcharges
  • Points on your driver’s license
  • Payment of a driver assessment fee
  • Personal injury claims if you hit someone with your vehicle
  • Potential criminal conviction
  • Potential manslaughter or murder charges
  • Suspension of driving privileges
  • Suspension or revocation of your license

Things to Remember If You Are Stopped for DWI

  1. Follow the directions of the police officers. Rarely can you win your case by pleading or arguing on the side of the road.
  2. Make sure the police officers are aware of any physical or mental impairment that you may have that is not related to the consumption of alcohol.
  3. Remember that refusal to take a Breathalyzer test or to perform field sobriety tests will make it more difficult to convict you of driving while intoxicated but will result in more serious suspensions or revocations of your driving privileges.  Conversely, taking tests and making admissions will help maintain driving privileges and may also help your court case.  However, very often it increases the chances of conviction.
  4. Ask to speak to a lawyer before you take a Breathalyzer test (even if it is late at night).
  5. Stay calm, be courteous and be polite.
